Iowa dog bite laws and when to call an attorney

Iowa's dog statute reaches past the bite itself. The owner pays when the dog attacks or even tries to bite a person and the main escape is proof that you were doing something unlawful that helped cause it.

Is Iowa a strict liability state for dog bites?

Yes and the rule is wider than a bite. Iowa Code section 351.28 makes the owner liable for all damages done by a dog that is attacking or attempting to bite a person. If the dog lunged and you fell on the ice trying to get away, the statute can still reach that harm.

The law does not ask whether the dog had a bad record. What it asks is what you were doing. An owner escapes only by showing you were committing an unlawful act that directly contributed to your injury, such as breaking into a shed.

One narrow carve out exists. A dog sick with rabies, which the statute calls hydrophobia, is left out unless the owner had reason to know about the illness and could have prevented the harm.

How Iowa splits the blame

Strict liability does not switch off Iowa's fault rules. Iowa Code section 668.1 defines fault to include acts that subject a person to strict tort liability, so a dog statute claim goes through the same comparison as a car crash.

Under Iowa Code section 668.3, your own share of fault cuts your award by that percentage. You lose the claim only if your share is greater than the combined fault of everyone you sued. Expect an insurer to ask whether you reached toward the dog or walked into its yard.

Iowa dog bite statute of limitations

An adult has two years. Iowa Code section 614.1, subsection 2 covers actions founded on injuries to the person and a dog attack is one of them. Count from the day of the attack, not the day the scar settled.

A bitten child gets more time. Iowa Code section 614.8 extends the deadline so a minor has one year after reaching majority and minority in Iowa ends at 18. Waiting that long makes witnesses and records harder to find, so read our notes on a dog bite on a child before you decide.

Police dogs, city dogs and the confinement order

After a report, the local board of health orders the owner to confine the animal as it directs. Iowa Code section 351.39 lets the board impound a dog whose owner ignores that order and after ten days it may destroy the animal. That section does not apply when a police service dog bit someone while on duty.

A claim against a city, county or other municipality follows its own timing. Iowa Code section 670.5 requires the suit within two years after the injury, with the same extension for minors.

When an Iowa dog bite lawyer helps most

The two questions in an Iowa case are simple to state and hard to prove. Was the dog attacking? Were you doing anything unlawful? Neighbors, a doorbell camera and the board of health record often answer both.

A lawyer can collect those pieces while they still exist and find the homeowner or renter policy that covers the dog. Starting early leaves room inside the two years for real talks with the insurer.
